This does not pertain to me but a friend. He got his 2nd DUI a while back his court date was pushed back because of a preliminary or something. His BAC was over the .16. He has a lawyer, and his court date is on Wed. He did the classes the first time and it was about 3-4 years ago approx.

What is he going to get? Will he get the max jailtime and will he go to a state prison? He tried for house arrest in the county he got caught but they denied him cuz noone lived there that he could stay?

Enlighten me on what you guys know, and what he will prolly get...He got caught in PA...He spent 5 hrs in jail that night...

I think its 90days in jail is the law...

loss of license for 2 yrs. and from what people have told me, if you do get jail time they allow you to do it on the weekends. he will also have to attend AA meetings and IDRC

Yea he knows all that is comming but he really doesnt want to go to jail. I just think that its a waste of space if they put these ppl in jail. But then on the other hand maybe this needs to be done..?

Second Offense - $500.00 to $1,000.00 fine, $100.00 DWI surcharge, $75.00 safe neighborhood penalty, $50.00 Violent Crimes Compensation Penalty, court costs, 2 year loss of license, 48 hours in an IDRC program in lieu of 48 in jail, 30 days of community service and up to 90 days imprisonment and a surcharge of $1,000.00 per year for 3 years.

my understanding is that if he has a lawyer, chances are he'll skate on the jail time. of course, this is still all up to the judge. good luck

Yes he has a very good lawyer but it is all up to the judge...
